Terms and Conditions
All bookings are made with Magunatip Holidays Sdn Bhd.
By booking a trip with us you are deemed to have agreed to these Booking Conditions and your booking will be accepted by us on this basis. The serviced to be provided are those referred to in your booking confirmation invoice.
Dates and itinerary are valid until 31 December 2019. Beyond 31 December 2019 dates and itineraries are indicative only.
Please note that full payment is required for bookings.
Please note that reservation will NOT be process without payment.
4.Prices and Surcharges
Our trip prices are subject to variable and seasonal pricing,both of which are standard practice within the industry. This means our trip prices may vary at time in accordance with demand,market conditions and availability. Your best option if you like the price you see is to book at that time. Any reduced pricing or discounts that may become available after you have paid will not apply. If you wish to cancel your booking to take advantage of a cheaper price,full cancellation conditions apply.
In order for us to confirm your travel arrangements you must provide all requested details during booking of tour. Necessary details vary by trip; they include but are not limited to full name as per passport,date of birth,nationality,passport number,passport issue and expiry date.
You are strongly advised to take out cancellation insurance at the time of booking which will cover cancellation fees. If you leave a tour for any reason after it has commenced we are not obliged to make any refunds for unused services. If you fail to join a tour,join it after departure,or leave it prior to its completion,no refund will be made. The cancellation fee are in addition to fees which may be levied by accommodation providers,travel agents or third party tour and transportation operator fees.
If you cancel some or all portions of your booking cancellation fees will apply. A cancellation will only be effective when we receive written confirmation of the cancellation.
If you cancel a trip :
Minimum 7 days cancellation written confirmation required
The cancellation policy set by individual hotel or between 07 - 21 days prior to check in days
depending on the season.
A 1 room night cancellation charge will be imposed if a confirmed reservation is cancel less than cancellation period as per stated by the hotel cancellation policy. During certain peak season's stiffer cancellation condition and charges may be imposed.
Cancellation terms and conditions are subject to change without prior notice cos it varies from hotel to hotel.
We will reconfirm period via email upon confirming your reservation. All cancel and changes to the reservation must be made through Magunatip Holidays by written notice either by email. We do not accept cancellation by phone, hotels will not entertain direct interventions as we are their agent.
If you were to cancel directly with hotel itself , we will not entertain any dispute , promises or refund that transpire between your good self and the hotel staff all.
6.2 Magunatip Holidays will only imposed charges for hotel rooms or tour package. Other expenses incurred by the customer is payable to the hotel or local tour representative. For instance , the customer is required to pay directly to the hotel for any extras such as food and beverage consume, room services , pay perview tv , minibar expenditures , telephone charges etc. If the customer encounters any double charging on the hotel room, the user is required to contact the hotel directly for the refund. Double charging occurs when the user is charge twice once by Magunatip Holidays and another by the hotel.
Please take note that the hotel cannot charge the customer again for the hotel room except if the user extends his/her stay or additional rooms have been requested for.
Similarly tour packages cover only the basic stipulated destinations.
Any extensions to the tour or additional expenses incurred will be payable to the local tour agent/operator. We reserve the right to change,amend or alter prices and / or tour itinerary / or any of the conditional stated herein from time to time with or without prior notice.

7. Refund Policy
We will refund the full amount to customer the cancellation is made before the specified none cancellation period. With regards to cancellations made within the none cancellation period , the user will be refunded the entire billed rate less any cancellation and administrative charges. The amount refunded will vary accordingly to the hotels NCP and cancellation charges. All customers are advised to check the respective hotels NCP and its charges before making any reservations. Refunds will not be granted for no show reservations ( does not check in ). In addition , Magunatip Holidays reserves the right to refused any payment or refund whether to the customer or hotel for agreements and / or separate agreements made between the customer and the hotel on refunds or cancellations of bookings. In the case of cuts short stay (immature stay) after check in the hotel.
The customer should approach the hotel directly for refunds subject to the hotel policy.
8.Passport and Visas
You must carry a valid passport and have obtained all of the appropriate visas,pemits and certificates for the countries which you will visit during your trip. Your passport must be valid for 6 months beyond the duration of the trip. It is your responsibility to ensure that you are in possession of the correct visas,permits and certificated for your trip. We are not responsible if you are refused entry to a country because you lack the correct passport, visa or other travel documentation.
Travel insurance is mandatory for all our travelers and should be taken out at the time of booking. Your travel insurance must provide cover against personal accident, death, medical expenses and emergency repatriation. We also strongly recommend it covers cancellation,curtailment,personal liability and loss of luggage and personal effects.
You appreciate and acknowledge that the nature of this type of travel requires considerable flexibility and you should allow for alternatives. The itinerary provided for each trip is representatives of the types of activities contemplated but it is understood that the route ,schedules,itineraries,amenities and mode of transport may be subject to alteration without prior notice due to local circumstances or events.
11.Limitation of Liability
We contact with a network of companies,agencies and individuals to assist in the running of our trips as agent for these third parties. We are not responsible for the acts and omissions of these third parties.
To the fullest extend permitted by law:
- any liability for any loss , death , injury , or damage which you may suffer directly or indirectly in connection with or arising out of your participation in a trip, or any breach of the conditions.
- you release us and our officers , employees , agents and representatives from any liability and expressly waive any claims you may have against us arising out of or in connection with your participation in a trip and
- any condition or warranty which would otherwise be implied by law into these Booking Conditions.
Any claim by you is excluded to the extend that it is for indirect or consequential loss,loss of profits or economic loss, however it arises ,or for indirect , special, punitive or exemplary damages.
12.Photos and Marketing
You consent to us using images of you taken during the trip for advertising and promotional purposes in any medium we choose. You grant us a perpetual, royalty free, worldwide, irrevocable licence to use such images for publicity and promotional purposes.
We recognize that the protection of personal information of our customers and all who are concerned with our company is our social responsibility. We are committed to carrying out the following policies in the protection of personal information.
13.1. In the case of requesting personal information, we will identify the purpose of use thereof and obtain such information only to the extent necessary for conducting business and through a lawful and reasonable manner and will use and/or provide such information only within the limits of the stated purposes.
13.2. We will implement safety rules to manage risks concerning all the personal information handled in our company, such as being accessed in an unauthorized manner, being leaked, lost, or maliciously damaged or destroyed, and will take organizational, personnel, physical and technological measures to prevent risks and corrective measures if a problem occurs
13.3. In the case of outsourcing some of our operations to other companies handling personal information, we will request and supervise such contractors to handle the relevant personal information in the same proper manner as handled in our company.
13.4. We will observe laws and ordinances on protection of personal information, governmental guidelines and other social norms, and will endeavor to continually improve through regular review
13.5. In the case where any customer requests our company to disclose and/or correct personal information that has been kept by our company and which belongs to such customer, we will respond appropriately in accordance with laws and ordinances on protection of personal information, and other social norms. We will respond in good faith to any and all complaints or consultation requests regarding personal information that has been kept by our company.
